Deputy Arrested for Drunk Driving, Crash — Was More Than 2.5X Legal Limit

WHITLEY COUNTY, Ind. — A Sheriff’s Deputy in Whitley County is facing several criminal charges after the Indiana State Police say he crashed his truck while driving drunk. According to court documents obtained by REAL News Michiana, Deputy Brandon K. Smith had a blood alcohol level of .204, two-and-a-half times the legal limit.

Police reports state Smith, 37 of Columbia City, crashed his F250 near the intersection of S. County Road 700 and E. County Road 400 S. at approximately 1:30am on December 14th. The report states smith hit a utility pole and a parked pickup truck in front of a home. The impact caused the parked truck to spin and hit two other parked vehicles. Investigators also found an open beer in the center console.

Smith is being charged with two misdemeanors: Operating a Vehicle While Intoxicated Endangering a Person and Oper Veh w/ Alcohol Concentration Equivalent to .15 or More.

Because of a potential conflict of interest, the case has been moved out of Whitley County. The case will now be handled in Stuben County court. A special prosecutor out of Huntington County will be handling the prosecution.

Smith is due in court for his initial hearing on February 4th.
