SJC Dem. Party falsely claims gay marriage under attack by Indiana GOP bill

SOUTH BEND, Ind. — The St. Joseph County Democrat Party took to social media to spread false and misleading information claiming Republican Indiana lawmakers are attempting to outlaw same-sex marriage. The false claims come as GOP state legislators look to change the term “gender” to “biological sex” in all Indiana statutes.

The false information being spread by the St. Joseph County Democrat Party revolves around House Bill 1291. According to a summary of the bill on Indiana General Assembly’s website, the bill’s purpose is to replace “the term ‘gender’ with the phrase ‘biological sex’… in which the term is used to describe the condition of being physically male or female.” The bill is designed to protect women, that’s it.

The 69 page bill outlines ALL instances of the term “gender” being used in Indiana statutes and changes it to “biological sex,” including old laws that are still on the books but have been overturned by Supreme Court precedent, including same-sex marriage. The St. Joseph County Democrat Party took a screenshot and posted it to Facebook showing one paragraph from the 69 page bill in which the term “gender” is changed to “biological sex” making it appear as if GOP lawmakers were introducing a bill to outlaw same-sex marriage.

“Roe was a warning. Many warned that Obergefell was next. Here is the proof.” The St. Joseph County Democrat Party falsely stated in its post to Facebook.

There’s only one problem — the law being cited is already on Indiana’s books and hasn’t been amended since 1997. It was simply made null-and-void by the Supreme Court of the United States in the Obergefell v. Hodges decision in 2015 which made same-sex marriage the law of the land. House Bill 1291 does not impact or challenge the Obergefell decision whatsoever.
